We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
DATA RETENTION
When you place an order through the Site, we will maintain your order information for our records in line with the requirements of the GDRP, the new data protection law from May 25th 2018, unless and until you ask us to delete this information.
YOUR RIGHTS
If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. MINORS
The Site is not intended for individuals under the age of 16yrs. Any person under the age of 16 who wishes to use the site should do so with permission from a parent or guardian.
TERMS & CONDITIONS
PLACING AN ORDER

We accept online order transactions via our secure server. All credit/debit card transactions are subject to validation checks and are authorised by the card issuer. If the issuer of your card refuses to authorise your payment to us, we will not be liable for any delay and/or non-delivery of your order. No binding contract will exist between us until we have accepted the order. All goods are sold subject to availability and may be made to order. If for any reason we are unable to fulfil any part of the order, we will make you aware of this and refund your card as soon as is practical and in any case within 21 days.
CANCELLATION OF BESPOKE ORDERS

In accordance to the Distance Selling and Online Trading Regulations, Ellen Merchant products which have been made to the customer's specifications are exempt from standard cancellation rights. Cancellations are offered subject to the discretion of Ellen Merchant and will be un-refundable if full production of the order has begun. Please contact us as soon as possible at studio@ellenmerchant.co.uk if you wish to cancel a product which is made to order.
OWNERSHIP OF GOODS

All items supplied to the customer remain the property of Ellen Merchant until the final payment of all sums owing in respect to those goods has been received in full.
RESPONSIBILITY

Ellen Merchant cannot be held responsible for any disruptions to our services that are beyond our reasonable control. We will do everything in our power to correct any disruption to our service.
These terms and conditions will apply to all transactions placed online with Ellen Merchant. The terms will not affect your statutory rights. By using this site you are agreeing to the terms and conditions.
CANCELLATION

You may cancel a contract to purchase a product or products from us at anytime before your order has been fulfilled and dispatched. In order to cancel a contract in this way, you must give us written notice of cancellation via email. Please let us know as soon as possible if you wish to cancel an order at studio@ellenmerchant.co.uk.
RETURNS

We hope that you love your purchase, but in the event that you are not happy with your order, Ellen Merchant will exchange or refund products provided that they are returned in the original condition, with the original packaging and within 14 days of receipt to: Ellen Merchant Ltd, Unit 3 The Sulivan Enterprise Centre London SW6 3DJ. Please request a proof of postage and purchase adequate postage insurance. Please note that goods being sent back to Ellen Merchant are the responsibility of the customer until they reach us. Ellen Merchant cannot be held responsible for anything that gets lost or damaged in transit. Delivery charge and returned postage will only be refunded should an item be faulty.

All copyright, design rights and intellectual property rights existing in our designs and products and in the images, text and design of our website are and will remain property of Ellen Merchant. The copying, modification, distribution, reproduction or incorporation into any other work of part or all the material available on this website in any form is prohibited without permission.

These Terms & Conditions and your use of our website are governed by English law and the customer agrees to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights.
This website and our terms and conditions have been designed for use within the United Kingdom and under UK law. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you.
PRODUCT PRICING & CONTENT

Every effort is made to ensure images and colours shown on the site match as closely as possible to those of the actual products but due to technical limitations, some colours may vary on different devices. All prices are show in pounds sterling. The final price quoted on the payment page is the price of the goods including delivery to the stated destination. Prices, product descriptions and specifications are checked to the best of our ability to makes sure that they are accurate at the time of going online. Data entry errors or other technical issues may result in errors. In such cases it is not required to honour incorrect pricing. Prices and availability of products are subject to change without notice. The advertised delivery charge will be added to your order.
DELIVERY

All our items will be sent out using tracked delivery and the tracking information will be provided via email when dispatched. The customer is then responsible for tracking the delivery and ensuring that they are able to receive it. In the event that your order does not arrive within the expected time frame, please do make us aware of this by contacting studio@ellenmerchant.co.uk within 7 days of the expected delivery date so that we are able to help find the missing item or make a claim to replace it. Ellen Merchant is not liable for any missing goods that have not been reported missing within 2 weeks of the order being placed.

In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. We do not disclose details of our customers to any third party but we do use it to advise our clients of our goods and services we feel may be interest to them through our monthly newsletter, unless instructed otherwise in writing. We will collect and store any personal data that you may volunteer whilst using our services e.g. placing an order or joining our email newsletter. The type of information that we will collect may include – your title and name, address, telephone numbers, email address, order details. The information will be used to process orders, for internal record keeping and we may periodically send promotional emails about new products, special offers or other information that we think you may find interesting using the email address you have provided.
